UCCM JUSTICE PROGRAM

UCCM police officers play an important role in the diversion process, as pre and post charge cases can be referred to the UCCM Justice Program. More involvement with all aspects of the Justice Program is an important goal of the Service. Post charge diversion by the Crown Attorney represents the majority of UCCM Anishnaabe Police Service cases that are referred to diversion, vs. comparison to pre-charge diversion by officers. Pre-charge diversion are those incidents that can be referred directly by officers, and 'by-passing' the court system altogether.

The following are yearly summaries of the # of cases diverted under the traditional justice model:

Year 2006 - Total charges laid 268; # of Diversions = 10 (3.73%)

Year 2005 - Total charges laid 380; # of Diversions = 19 (5.00%)

Year 2004 - Total charges laid 296; # of Diversions = 15 (5.07%)



Types of Charges that have been diverted to the UCCM Justice Program:

* Breaking and Entering with Intent

* Take Motor Vehicle without Consent

* Possession of Stolen Property < $5000

* Careless Use of a Firearm

* Possesion under CDSA

* Fail to Appear

* Assault

* Theft Under $5000

* Mischief Under $5000

* Breach of Probation

* Causing Disturbance

* Trespassing at Night


For fiscal year ending March 31, 2004 there were 15 circles scheduled during this period as a result of charges diverted to the Project. UCCM officers attended five out of these fifteen circles.

For the fiscal year March 31, 2003, there were approximately 23 circles that were diverted. Out of these circles, approximately 14 justice circles were attended by U.C.C.M. police officers.
